1. Who this is for
This notice is for Washington residents, and for anyone whose information we collect in Washington. What the Legbots device and app measure is performance data: how the device performed and how you moved while using it. It is not medical information. Washington's My Health My Data Act (RCW 19.373) requires a notice of this kind; to the extent that law reaches any of our performance data, this notice applies. It explains what we collect, why, who sees it, and your rights, and it applies in addition to our Privacy Policy. Where this notice and the Privacy Policy differ for you, this notice governs.
Legbots Assist is a general wellness product, not a medical device. Nothing here makes it one, and nothing it measures is medical information.
2. What we collect, and why
What you tell the app when you set it up: your name, age, sex, height, weight and goal. The app uses them to work out your numbers.
How you move, from the device and the app: step count, cadence, stride and stance timing, left and right symmetry, how far each leg swings as the device reads it, upper-body sway, the readings from the weekly test (standing still, standing up, walking and marching), the assistance levels and modes you use, session length, instability detection events, and how the device and app were used: battery levels in sessions and how often you open the app.
What the app works out from how you move: distance, estimated calories, repetitions, fatigue and consistency measures, the weekly-test leg score, readiness and Movement Age scores, personal records, and other scores the app calculates from your walking.
Questions you type into the app's Ask feature, and, if it passes you to a person, the question and your numbers it used.
We use it to show you your own numbers in the app, to run and support the device and the app, to fix faults, and to make the product better. If an organization owns the device you use, we also use it to show that organization your profile's numbers under the code it assigned or a display name its staff chose (§4).
What you tell us about fit: your height and waist measurement if you give them when you book a fitting call, and your leg-strap measurements and weight if you tell us on the call. We use them only to answer your questions about fit.
We do not collect your medical history, your diagnoses or your precise location.
3. Where it comes from
From you, when you set up the Legbots app. From you, through the device and the app. From you directly, when you book a fitting call or tell us on one. If an organization set up your profile, from that organization: the code it assigned, and a display name if its staff gave one.
4. What we share, and with whom
The organization that owns the device, if you use one that an organization bought: your profile's movement measurements and the scores worked out from them in §2, under the code it assigned or a display name its staff chose, never the name you typed in the app, and only after you agree to it in the app (§6). It can download and print what it sees. If you withdraw, it stops seeing your figures straight away, but copies it already downloaded or printed stay with it. Until you agree, the organization sees your profile's code and nothing else.
The person who bought the device, if that is not you: nothing of yours, unless you agree to it in the app. Their account shows their own profile, and yours only with that agreement.
Companies that process it for us, under contract and only on our instructions: Google Firebase, which stores it, and Vercel, which runs our website and the account page that shows it.
We have no affiliates that receive it. We do not sell it, and we do not use it for advertising. We do not share what you tell us about fit with anyone other than the companies above that store it for us.
5. Your rights
You have the right to:
- Confirm whether we collect, share or sell your performance data, and see it, with a list of every third party and affiliate we shared it with and how to contact them. Seeing it means your own data, not how our software works it out: we do not give out our algorithms or models.
- Withdraw your consent to our collecting or sharing it.
- Have it deleted. We delete it from our records, including archives and backups, and tell every company that processes it for us, and any organization we shared it with, to delete it too. Deletion from a backup can take up to six months, until that backup is next restored or replaced.
How to ask: in your account at legbots.com, under Settings, "Your data", or email orders@legbots.com. We confirm who you are before we act, using the email address on your account. If an organization set up your profile, email us your profile code and the device's serial number, and we confirm the request through that organization.
When: we complete your request within 45 days. If we need longer, we tell you why within those 45 days, and we take at most 45 more. It is free, up to twice in any 12 months. Beyond that, or if a request is manifestly unfounded, excessive or repetitive, we may charge a reasonable fee or decline it.
If we say no: reply to our decision, or email orders@legbots.com with "Appeal" in the subject, and a different person reviews it. We answer within 45 days of your appeal, in writing, with our reasons. If we still say no, you can complain to the Washington State Attorney General at atg.wa.gov/file-complaint.
We will not treat you differently for using any of these rights.
6. Consent
Before the app collects your movement measurements in Washington, it asks for your consent. Before we share them with the organization that owns the device, the app asks for your consent to that separately. We record each consent with the version of its words, the time and how you gave it. You can withdraw either at any time, in the app or by email. Withdrawing stops the collection or the sharing from then on. The device keeps working either way.
We never collect, use or share performance data for a purpose this notice does not describe without telling you first and asking for your consent.
7. Changes
If we change this notice in a way that matters, we tell you by email and update the date at the top.
